Sale Description

The Trustee proposes to sell the Property to proposed buyer pursuant to 11 U.S.C. §§ 363(b) and (f) for a purchase price of $1,350,000. The property is being sold on an “AS IS, WHERE IS” basis without any warranties, express or implied, and without any contingencies, and free and clear of all liens, claims interests, and encumbrances, with such liens, claims, interests, and encumbrances to attach to sale proceeds. Potential purchasers seeking to submit an overbid must submit offers to counsel for the Trustee and to the Trustee no later than one day before the hearing on the Motion via email directed to Tamar Terzian (tterzian@bg.law) of intent to overbid and proof of financial ability to close escrow.

The initial Overbid is: $42,250.00; Subsequent Overbid Increments are: $10,000, with subsequent overbids being made in minimum $5,000.00.  To qualify, overbidders must deposit $42,250.00 and provide proof of financial ability to close escrow. The deposit must be remitted to the Trustee no later than one day prior to the hearing, payment in the form of a cashier’s check only (no other form of payment shall be accepted) made payable to “Wesley H. Avery, Chapter 12 Trustee”.
